4. Product Images, Colours and Appearance

This does not affect your rights where we make an error and the finished product does not match the correct information you submitted.

6. Changes to Personalised Orders

We will make reasonable efforts to amend your order if production has not yet started.

However, personalised products may enter production shortly after an order is placed.

We therefore cannot guarantee that an order can be changed or cancelled after it has been submitted.

Once production has started, changes or cancellation may no longer be possible.

7. Customer-Supplied Photographs, Artwork and Content

Where a product allows you to submit or upload photographs, logos, artwork, text or other content, you are responsible for ensuring you are legally entitled to use that content.

By supplying content to us, you confirm that:

  • you own the content; or

  • you have permission from the owner to use it for the product being ordered.

You grant us a limited right to copy, crop, resize, position, reproduce and otherwise process the supplied content where reasonably necessary to manufacture and fulfil your order.

You must not submit content that unlawfully infringes another person's:

  • copyright;

  • trademark;

  • privacy rights; or

  • other intellectual property or legal rights.

We reserve the right to refuse or cancel an order containing material that we reasonably believe to be:

8. Photograph and Image Quality

Customers are responsible for supplying photographs and images of suitable quality.

The quality of a finished printed photograph depends significantly on the quality of the image supplied to us.

Images may produce poorer print results where they are:

  • low resolution;

  • blurred;

  • heavily compressed;

  • screenshots;

  • downloaded from social media;

  • excessively cropped; or

  • otherwise of poor quality.

Where possible, you should upload the highest-resolution original photograph available.

We cannot guarantee that a poor-quality source image will produce a high-resolution finished print.

This does not affect your rights where a quality issue has been caused by an error in our production process.

9. Placing an Order

When you place an order through our website, you are offering to purchase the products selected.

You are responsible for ensuring that:

  • the correct product has been selected;

  • the correct size, colour and options have been selected;

  • personalisation details are accurate;

  • your email address is correct;

  • your billing information is correct; and

  • your delivery address is complete and accurate.

You should be given an opportunity to review your order before completing payment.

After placing an order, you will normally receive an order confirmation by email.

10. Acceptance of Your Order

An automated order confirmation confirms that we have received your order.

We may refuse or cancel an order where reasonably necessary, including where:

  • payment has not been authorised;

  • there has been an obvious pricing error;

  • product information contains an obvious error;

  • an item is unavailable;

  • we cannot fulfil the requested personalisation;

11. Prices

14. Production Times

Production, Dispatch and Delivery

For clarity:

Production time means the time needed to manufacture or personalise your product.

Dispatch means the point at which your order leaves us or our fulfilment facility.

Delivery time means the period taken by the delivery carrier after dispatch.

You should consider both production and delivery times when ordering for a specific date or occasion.

15. Delivery

We deliver to eligible UK addresses and may offer delivery to additional destinations where displayed during checkout.

Available delivery methods, prices and estimated delivery times will normally be shown during checkout.

Your order will be dispatched using an appropriate delivery service depending on:

  • the delivery method selected;

  • parcel size;

  • product type; and

  • destination.

Where appropriate, we may use a tracked delivery service.

Delivery estimates may be affected by:

  • bank holidays;

  • carrier disruption;

16. Next Working Day Delivery

Next Working Day Delivery is available only for products and delivery addresses that are eligible for this service.

2:00 pm Cut-Off Time

The cut-off time for eligible Next Working Day Delivery orders is:

2:00 pm Monday to Friday.

Orders must be successfully placed and payment completed before 2:00 pm on a working day to qualify for Next Working Day Delivery.

An eligible order completed before 2:00 pm on a working day will normally be processed for delivery on the following working day.

Orders completed after 2:00 pm will be treated as having been received on the next working day for the purpose of the Next Working Day Delivery service.

Examples

An eligible order completed at 1:30 pm on Monday would normally be due for delivery on Tuesday.

An eligible order completed at 3:00 pm on Monday would normally be processed from Tuesday and would normally be due for delivery on Wednesday.

An eligible order placed after 2:00 pm on Friday, or at any time on Saturday or Sunday, will normally be treated as having been received on Monday, provided Monday is not a bank holiday.

Weekends and Bank Holidays

Working days are normally:

Monday to Friday, excluding UK bank holidays.

Unless a separate weekend delivery service is specifically offered, Next Working Day Delivery does not mean delivery on Saturday, Sunday or a bank holiday.

Geographic Restrictions

Next Working Day Delivery may not be available or may require additional time for certain locations, including:

  • Northern Ireland;

  • Scottish Highlands and Islands;

  • Isle of Man;

  • Channel Islands;

  • UK islands;

  • remote postcode areas; and

  • destinations outside mainland UK.

Availability will depend on the delivery address, product and carrier service.

17. Royal Mail and Other Carriers

Some postal and courier services provide estimated rather than guaranteed delivery times.

Royal Mail First Class, Second Class and similar services do not necessarily guarantee delivery on a specific day unless the particular service selected includes a delivery guarantee.

Where tracking is available, tracking information may be provided after dispatch.

Not all delivery services provide full end-to-end tracking.

18. Delivery Address

You are responsible for providing a complete and accurate delivery address.

Please check the delivery address carefully before submitting your order.

If you discover an error after placing your order, contact us immediately.

Where an order has not yet been dispatched, we will make reasonable efforts to correct the address.

We cannot guarantee that an address can be changed after the order has entered fulfilment or has been passed to the carrier.

If delivery fails because an incorrect or incomplete address was provided by the customer, reasonable additional postage charges may apply if the order needs to be sent again.

19. Failed Delivery and Returned Parcels

If nobody is available to receive a delivery, the carrier may:

  • attempt redelivery;

  • leave the parcel in an appropriate safe place where permitted;

  • deliver the parcel to a neighbour where permitted;

  • direct the customer to a collection point; or

  • return the parcel to us.

The procedure used will depend on the carrier.

Where a parcel is returned because:

  • an incorrect address was provided;

  • the parcel was not collected;

  • delivery was repeatedly unsuccessful; or

  • carrier instructions were not followed,

we may charge reasonable additional delivery costs before resending the parcel.

We will not charge a customer for additional delivery costs caused by an error for which we are responsible.

20. Delivery Delays

We make reasonable efforts to meet the delivery times provided.

However, delivery may occasionally be delayed by circumstances outside our reasonable control.

If we become aware of a significant delay, we will take reasonable steps to deal with the issue.

Nothing in these Terms removes any statutory rights you may have where an order is delivered late or is not delivered within an agreed or legally required period.

21. Ordering for a Particular Occasion

Many products sold on GetPersonalisedGifts.com are purchased for occasions including:

  • birthdays;

  • weddings;

  • anniversaries;

  • engagements;

  • graduations;

  • Christmas;

  • Mother's Day;

  • Father's Day;

  • Valentine's Day; and

  • other celebrations.

We recommend ordering as early as reasonably possible.

Unless delivery by a specific date is expressly stated to be guaranteed, estimated delivery dates should not be treated as guaranteed.

Where delivery by a particular date is essential, customers should choose an appropriate guaranteed delivery service where available.

22. Cancellation of Non-Personalised Products

Where you purchase an eligible non-personalised product online, you will normally have a statutory right to cancel the purchase within 14 days of receiving the goods, subject to applicable legal exceptions.

You do not need to provide a reason for exercising an applicable statutory cancellation right.

23. Personalised and Custom-Made Products

The statutory change-of-mind cancellation right generally does not apply to goods that are made to a customer's specifications or are clearly personalised.

This may include products personalised using:

  • names;

  • photographs;

  • messages;

  • dates;

  • initials;

  • engraving;

  • embroidery;

  • personalised artwork; or

  • other bespoke details supplied or selected by you.

Once production of a personalised or made-to-order item has started, the order cannot normally be cancelled or returned simply because you have changed your mind.

This does not affect your statutory rights.

If a personalised item is:

  • faulty;

  • damaged;

  • not as described;

  • materially different from what was ordered; or

  • personalised incorrectly because of an error made by us,

please contact us so that the matter can be resolved.

24. Perishable Goods

Certain products, including food, chocolate, sweets and some hamper contents, may be perishable.

Applicable consumer legislation provides exceptions to normal change-of-mind cancellation rights for certain perishable goods.

Where such an exception applies, we are not required to accept a return simply because you have changed your mind.

This does not affect your rights where the goods are faulty, damaged, incorrect or not as described.

25. Faulty, Damaged or Incorrect Products

Reporting Damage

Where reasonably possible, we ask customers to report visible damage or an incorrect item within 72 hours of delivery.

Please provide clear photographs showing:

  • the product;

  • the fault or damage;

  • the packaging where relevant; and

  • the shipping label where reasonably required.

Photographs help us investigate problems and resolve them more quickly.

The request to contact us within 72 hours does not remove or reduce your statutory consumer rights.

Depending on the circumstances and the rights available to you, the appropriate remedy may include:

  • repair;

  • replacement;

  • refund; or

  • another remedy required by law.

26. Returns

Please do not send a product back to an address unless the correct return details have first been confirmed.

Where an eligible non-personalised product is being returned because you have exercised a statutory change-of-mind cancellation right, you may be responsible for the direct cost of returning the product where permitted by law and where you were informed of that responsibility.

Where a product is being returned because it is faulty, incorrect or does not conform to the contract, return costs will be dealt with according to your statutory rights.

Where reasonably possible, returned products should include their original packaging and accessories.

Your statutory rights are not dependent upon retaining packaging where the law provides otherwise.

27. Condition of Returned Goods

Where you exercise a statutory cancellation right for an eligible product, you may handle the product to the extent reasonably necessary to establish its nature, characteristics and functioning.

If a product has been handled beyond what would reasonably be permitted when examining it in a shop, we may be permitted by law to make an appropriate deduction from the refund to reflect any reduction in value.

28. Refunds

Where you are entitled to a refund, it will be processed in accordance with applicable UK consumer law.

For eligible online cancellations, refunds are generally required within the applicable statutory period.
